AB 353: Why Californiaโs Low-Income Broadband Mandate Could Break the Industry.
Broadband affordability is a priorityโbut Californiaโs AB 353 may do more harm than good. AB 353 proposes a state-mandated broadband plan requiring every ISP operating in Californiaโregardless of size, technology, or funding statusโto offer 100/20 Mbps service for just $15/month to qualifying low-income households.
This follows a similar law passed in New York, which required large ISPs (20,000+ subscribers) to offer a 25/3 Mbps plan for $15/month. While flawed, New Yorkโs version at least excluded smaller providers. Californiaโs version does not.
Everyone wants to close the digital divideโbut one-size-fits-all pricing mandates are not the solution. Especially in rural America, where the economics of broadband are already fragile, AB 353 could collapse the very networks meant to provide access.
